Observation Week Agreement (Trial DPA + NY §2-d)
The single short agreement a school signs for a free 7-day observation week: FERPA processor terms and the NY §2-d protections, scoped to a read-only week in which no family is contacted.
What the week is
AskElira reads your applicant records and your staff’s enrollment notes from your student information system, and shows your staff the messages the service would send. That is the whole scope, and it lasts seven days.
Nobody is contacted
No email, text, WhatsApp message, or call reaches any guardian, parent, student, or family during the observation week, and nothing is written back to your SIS. Your account is created in observe mode, which structurally excludes it from every process capable of contacting a family — nothing is queued to send later, and nothing is deferred to the end of the week.
Short scope, full protections
The agreement is short because the week is narrow, not because the safeguards are lighter. Every element §2-d and Part 121 require of a third-party contractor is here: exclusive purposes, no sale and no marketing, no AI training on your data, subcontractor safeguards, staff training and confidentiality, NIST-aligned security with encryption and enforced multi-factor sign-in, 48-hour breach notice, and the §121.3 supplemental information for your Parents’ Bill of Rights.
Exactly what is read
Guardian name, phone, email and preferred language; student name; seat and application status with your SIS’s own record identifiers; grade level and campus; waitlist position; which registration documents are in or missing — never the documents themselves; an IEP yes/no flag; and the enrollment notes your staff share, with SSN-shaped text redacted before storage. No attendance data, no document contents, no academic records, no health information, no Social Security numbers.
Your data is deleted
Unless you execute the full packet, everything received is deleted within 14 days of the week ending — automatically, without you having to ask. Your SIS credentials are destroyed when the week ends. You can demand deletion at any time and get written confirmation, and you can ask for a copy of what we hold before it goes.
No fee, no obligation
No payment method is collected, no invoice is issued, and the week does not renew or convert on its own. Converting is a separate, deliberate signature on the full packet.
